Important Statements on Cryptocurrencies from the Finance Committee Debate Report

Will there be a crypto ban?

In the recently published Finance Committee Debate Report on Crypto, the possibility of a crypto ban was discussed. A significant number of Dutch individuals have suffered financial losses due to cryptocurrencies, leading to a proposal for a complete ban on crypto by the Central Planning Bureau.

However, committee member Heinen of VVD believes that while there are similarities between crypto and gambling, a total ban would be an extreme measure. Minister Sigrid Kaag of Finance also supports this view and thinks that a general crypto ban is unnecessary. Instead, they advocate for regulation to address the issues associated with cryptocurrencies.

The Europese crypto wet MiCA

The Markets in Crypto Assets Act (MiCA), enacted by the European Union and set to be effective in 2024, aims to regulate and standardize the crypto industry. Minister Sigrid Kaag expresses enthusiasm for this law, considering it a strong foundation for crypto regulation in the Netherlands.

In the interim period until the MiCA law is implemented, there will be limited or no specific national regulations regarding cryptocurrencies in the Netherlands. Minister Kaag highlights that the Dutch government will wait for the MiCA law to come into force before drafting its own legislation.

Once MiCA is enacted, the Public Prosecution Service will have the authority to take action based on European legislation. This includes the power to block the websites of crypto exchanges that fail to comply with the regulations set out by MiCA. The ministry also expresses concerns about the advertising and influencer practices in the crypto industry, specifically regarding addiction sensitivity and pump-and-dump promotions.

Possible climate rules for bitcoin mining

During the debate, the ministry acknowledged the environmental impact of bitcoin mining, which consumes a significant amount of energy and contributes to pollution. However, the ministry currently has no immediate plans to address the climate concerns associated with crypto.

Instead, a comprehensive investigation into the climate problems related to crypto mining will be conducted 1.5 years after the implementation of the MiCA law. The findings of this investigation will determine the effectiveness of the MiCA legislation and inform future measures. Subsequent adjustments may focus on issues such as tax evasion and advertising.
